During the course of the program, you will develop an in-depth understanding of the essentials related to payroll, social security, individual income tax, and tax implications for the organization and individual related to cross-border labor dispatch. Further you will gain valuable insights in efficiently managing personnel within the organization utilizing the legal framework provided by the PRC Labour Contract Law, the employment contract and employment handbook. Finally, focus goes out to the management of labor disputes and termination of employment relationships.

The program covers all literature essential to acquiring the fundamental knowledge for doing business in China and with China-based enterprises.
Duration
The standard duration of the course is 16 weeks based on an average time commitment of 8 hours per week.
Structuring Employment Contracts
- In this module you will develop a deeper understanding of the different types of employment contracts related to individual, collective and part-time employment.
- You will develop in-depth insights into the requirements for conclusion of the different types of employment contracts.
- You will learn to translate law and regulations into business practice, utilizing examples of provisions which can be included in individual employment contracts drafted in accordance with the PRC Labour Contract Law.
- You will earn insights in the purpose and functioning of employment handbooks.
Contracting Freelance Personnel
- In this module you will develop a deeper understanding of the different types of employment contracts related to individual, collective and part-time employment.
- You will develop in-depth insights into the requirements for conclusion of the different types of employment contracts.
- You will develop a profound understanding of the regulations regarding work placement and will be able to establish arrangements between the hiring company, staffing firm and dispatched employee.
Understanding Payroll, Social Security, and Individual Income Tax
- In this module you will learn how China’s payroll system is designed and salary is calculated.
- You will develop an understanding of China’s social security system is designed, which components exists and how contribution is arranged.
- You will gain in-depth insights in how the individual income tax framework is designed, understand the difference between a Resident and Non-Resident Taxpayer, Tax Residency and Taxability of income, and how it exactly impacts taxation borne by the employer and employee.
- You will get insight into the different types of income components, how these are taxed, and understand tax deductions under China’s new Individual Income Tax Law.
- You will develop a better understanding of the development of current preferential tax policies.
China Secondment: Tax Implications for Cross-border Labor Dispatch
- In this module you will develop a deeper understanding about structuring secondment assignments for your employees to China.
- You will learn to assess the tax implications for the home entity from where the employee is dispatched, for the China-based entity where the employee will take up a work assignment based on how the business activities are structured in combination with the details of the secondment assignments.
- You will develop an understanding of China’s payroll administration, individual income tax and social security systems
- You will develop a deeper understanding of the individual income tax implications for employees when working in China as secondee.
- You will gain insights into the risks associated with secondment and the means to mitigate these.
- You will develop an understanding of the classification and payment of secondment fees.
The Importance of the Employment Handbook for Efficient Personnel Management
- In this module you will learn about the importance and interconnectivity of the employment handbook for efficient personnel management in combination with the PRC Labor Contract Law, and regulations.
- You will develop an in-depth insight in the topics that have a direct impact on the employees’ rights and interest, such as rules on labor compensation, working hours, leave and rest, occupational safety and hygiene, insurance and welfare, training, work discipline and work quota management.
- You will learn how to structure and align content included in the employment contract and employment handbook.
Managing Labor Disputes and Termination of Employment
- In this module you will learn different ways to manage and mitigate labor disputes and the different ways to terminate employment relationships.
- You will develop an understanding of the different steps part of the dispute escalation trajectory in China, and how follow up on each of these steps is legally structured.
- You will gain in-depth insights in how to manage labor disputes with employees who hold individual employment contracts, collective employment contracts and with employees who hold placement contracts.
- You will get insight into the legal grounds for terminating employment relationships, executed unilaterally by the employee, by the employer as well as termination following mutual agreement.
- You will learn when it is compulsory for the employer to pay financial compensation to the employee upon termination of the labor contract, as well as how compensation is calculated.

No specific prior education or knowledge about foreign investment into China is required to be admitted to this program.
Prior completion one or multiple of the Institute of China Studies’ Certificate or Diploma courses included in the program as a standalone course is recommended.
Assessment
Assessment is carried out through a series of written assignments to be completed at the end of each unit.
Certificate of Completion
A Certificate of Completion is issued upon the successful completion of the course.

Tuition fee
Tuition fee for the entire program is
- EUR 2.495 to be paid in a single installment in advance, or
- EUR 1.400 to be paid in two installments. Total tuition EUR 2.800.
The tuition fee includes all necessary literature and study materials, guidance and support during your studies, free extension of the study duration (if required), and 1:1 contact with your course professor.
Credit
Having completed one of multiple of Institute of China Studies’ Certificate or Diploma courses included in the program as a standalone course prior to the start of the program might result in credit of the tuition fee. Please contact us for more information.
