In this course you will develop a deeper understanding of the different types of employment contracts related to individual, collective and parttime employment, as well as the requirements for conclusion of these types of contracts. To translate law and regulations into business practice, examples of provisions which can be included in individual employment contracts drafted in accordance with the PRC Labour Contract Law are provided. Each provision is substantiated by additional information on the purpose of the provision, the meaning and implication of its content, and further information on the background to place the provision in a broader context.
Work placement in China is common. In this course the structuring of work placement arrangements between the hiring company, staffing firm and dispatched employee is discussed in detail, as well as restrictions applicable to work placement, remuneration and return of dispatched workers.
Further focus goes out to the employment handbook. The PRC Labour Contract Law requires employers to draft and implement an employment handbook within their organizations, which lists the rights of the employees, and specifies employment obligations. Employment handbooks should be regarded as an extension of the employment relationship in which the company clearly communicates the companies’ policies to its employees.

Unit 1: Introduction
The first unit provides an orientation to the course and the online learning environment. The unit does not carry credits. You are encouraged to go through the materials at their own pace to get accustomed to the online medium.
Unit 2: Individual Employment Contracts
In China employment relationships are mainly governed by the PRC Labor Contract Law and its implementation rules which have been implemented since 2008, in combination with state-level, regional and local related rules and regulations. The legislation applies to all companies located within Mainland China, including Foreign Invested Enterprises and covers both foreign and Chinese employees.
In this unit, the different types of employment contracts are introduced as well as the requirements for conclusion in combination discussed. Further a high-level overview of mandatory and additional provisions to be included in the employment contract is provided.
Unit 3: Main Provisions Included in Individual Employment Contracts
In this unit, examples of main provisions which can be included in individual employment contracts drafted in accordance with the PRC Labor Contract Law, its detailed implementation regulations are provided. Each section introduces a certain provision, which is substantiated by additional information on the purpose of the provision, the meaning and implication of its content, and further information on the background to place the provision in a broader context.
The provisions provided in this unit serve as reference only with the purpose to develop a better understanding of the detailed content included in individual employment contracts. The information is intended for general information purposes on the stated subjects and is not exhaustive treatment of any subject.
Unit 4: Collective Employment Contracts
In this unit the characteristics of collective employment contracts are introduced, including requirements related to the content, the process of conclusion, examination, revision, and termination is discussed, as well as rights and responsibilities of the parties involved in these processes.
Unit 5: Work Placement
Work placement in China has been mainly regulated via China’s Labor Contract Law, detailed implementation regulations and Interim Provisions for Labor Dispatch.
In this unit the structuring of work placement arrangements between the hiring company, staffing firm and dispatched employee is discussed, as well as restrictions applicable to work placement, remuneration and return of dispatched workers.
Unit 6: Part-time labor
The PRC Labor Contract Law defines part-time labor as a form of labor for which the remuneration is mainly calculated on an hourly basis, whereby the employee on average working hours for an employer does not exceed four hours per day and 24 hours per week.
In this unit the characteristics of part-time labor are discussed.
Unit 7: Employment handbook
The PRC Labor Contract Law requires employers to draft and implement an employment handbook within their organizations. In the employment handbook the rights of the employees are listed, and employment obligations specified. The handbook must be compliant with law and regulations and is subject to standards of fairness and reasonableness.
Employment handbooks should be regarded as an extension of the employment relationship in which the company clearly communicates the companies’ policies to its employees and provides its employees with detailed discipline records and measures in order to have the necessary evidence in hand should there be a need to prove grounds for implementing disciplinary measures.
No specific prior education or knowledge about personnel management in China is required to be admitted to this course.
Assessment
Assessment is carried out through a series of written assignments to be completed at the end of each unit.
Certificate of Completion
A course certificate is issued upon the successful completion of the course.
