In 5 weeks, you will gain an in-depth understanding of China’s labor contract law regarding the management, mitigation and follow up of labor disputes and termination of employment relationships, including the rights and obligations that apply in these situations to both employer and employees.
Labor disputes can be dealt with in different ways, varying from consultation between the parties, to mediation, arbitration and proceeding at court. In this course you will learn about the characteristics, regulations and obligations towards the parties of each of the steps involved in the dispute escalation trajectory.
You will learn about the legal grounds for the termination of employment relationships and develop an in-depth understanding in which instances the employee, and the employer are both allowed to unilaterally terminate the employment contact, when termination is not allowed and in which situations it is beneficiary for both parties to reach a mutual agreement.
In the course the legal grounds for financial compensation are discussed, and you will develop insight in the calculation for severance payment under different circumstances that might apply.

Objectives
- In this course you will learn different ways how to manage and mitigate labor disputes and the different ways to terminate employment relationships.
- You will develop an understanding of the different steps part of the dispute escalation trajectory in China, and how follow up on each of these steps is legally structured.
- You will gain in-depth insights in how to manage labor disputes with employees who hold individual employment contracts, collective employment contracts and with employees who hold placement contracts.
- You will get insight into the legal grounds for terminating employment relationships, executed unilaterally by the employee, by the employer as well as termination following mutual agreement.
- You will learn when it is compulsory for the employer to pay financial compensation to the employee upon termination of the labor contract, as well as how compensation is calculated.
Unit 1: Introduction
The first unit provides an orientation to the course and the online learning environment. The unit does not carry credits. You are encouraged to go through the materials at their own pace to get accustomed to the online medium.
Unit 2: Managing labor disputes – Individual employment contracts
in this unit you will gain insight in the various ways labor disputes can be dealt with, varying from consultation between the parties, to mediation, arbitration and proceeding at court. In this course you will learn about the characteristics, regulations, and obligations towards the parties of each of the steps involved in the dispute escalation trajectory.
Unit 3: Managing labor disputes – Collective employment contracts
In this unit focus goes out to the management of labor disputes with employees that hold collective employment contracts.
Unit 4: Managing labor disputes – Work placement contracts
In this unit focus goes out to the management of labor disputes with dispatched employees that hold work placement contracts.
Unit 5: Termination of employment
In this unit you will learn about the legal grounds for the termination of employment relationships and develop an in-depth understanding in which instances the employee, and the employer are both allowed to unilaterally terminate the employment contact, when termination is not allowed and in which situations it is beneficiary for both parties to reach a mutual agreement.
Unit 6: Financial compensation
In this unit the legal grounds for financial compensation are discussed, and you will develop insight in the calculation for severance payment under different circumstances that might apply to a case.
No specific prior education or knowledge about human resources management, labor disputes and termination of employment contracts in China is required to be admitted to the course.
Assessment
Assessment is carried out through a number of written assignments to be completed at the end of each unit.
Certificate of Completion
A course certificate is issued upon the successful completion of the course.
